INTRODUCTION
The services provided by KUBOGREEN by Davide La Mantia are governed by these "Terms and conditions of service". The "Terms and conditions of service" established by KUBOGREEN by Davide La Mantia shall be understood and considered an integral part of every single storage contract and of any other service concluded with the Client and cannot be separable from the contract itself.
DEFINITIONS
In the "Terms and Conditions of Service" that govern the storage contract and any other service concluded with the client, the following definitions apply: "we", "us", "our", the "authorized personnel" means KUBOGREEN by Davide La Mantia and any partners and collaborators; "Client/s", "you" and "your" means the client with a confirmed booking on the site.
TERMS AND CONDITIONS
The contract for storage and other services is stipulated with the company KUBOGREEN by Davide La Mantia, which agrees to store the luggage/objects of its clients in its luggage storage facilities. By leaving luggage in our premises and in the luggage storage, you accept the terms and conditions set out in our storage contract and/or in the contract for the provision of various services, on your own behalf and/or on behalf of any other interested person.
SERVICE DESCRIPTION – SELF SERVICE LOCKERS
The luggage storage service consists of the rental of automatic lockers for the storage of luggage / personal items at our stores for the period chosen by the customer during the booking phase. The Customer is informed that they have no right of withdrawal from the transaction, which they expressly waive in light of the specificity of the service, and that the booking is non-refundable. The booking email that KUBOGREEN by Davide La Mantia sends with the booking constitutes confirmation of the booking itself. The locations are open seven days a week. Working hours may vary slightly depending on the luggage storage. Bookings can be made on the website 24 hours a day.
Animals are prohibited in all lockers and/or in all premises. Smoking is not allowed inside our luggage storage facilities. Access is restricted to persons over 18 years of age or accompanied minors. No storage of perishable food is allowed. The maximum weight allowed per locker is 35 KG. The Customer is required to check the dimensions and weight before making a reservation. No claim or refund will be accepted if the luggage exceeds the dimensions and/or weight. The Customer must ensure that the locker door is securely closed.
The Customer may not leave valuable items in their luggage, for which the Customer remains responsible and for which KUBOGREEN by Davide La Mantia declines all liability. The Customer is required to verify that they have not left anything inside the locker. It is the Customer's responsibility not to leave any identity document or other travel necessity in the locker. Failing this, KUBOGREEN by Davide La Mantia can under no circumstances be held liable.
LATE COLLECTION IN SELF SERVICE LUGGAGE STORAGE
In the event of late collection of luggage during working hours, KUBOGREEN by Davide La Mantia will charge an additional fee for each hour of delay. Upon payment, the Customer will be able to collect their luggage. If collection does not occur or occurs on the following day (or subsequent days), a daily surcharge will be applied.
FORGOTTEN/FOUND LUGGAGE
For security reasons, any forgotten/found and unclaimed item or luggage will be destroyed 5 days after the end of the booking. If shipping of a forgotten item is requested, the Customer assumes all resulting shipping costs.
PROHIBITED AND DANGEROUS ITEMS
It is not permitted to store items prohibited by law and/or considered dangerous, as well as items that may cause harm to people, the environment or other luggage. KUBOGREEN by Davide La Mantia does not accept storage for the following items: plants and animals, alive or dead; negotiable securities and certificates (policies, currencies, banknotes, coins, credit cards, traveler's checks); other non-negotiable securities; pornographic or indecent material; weapons (firearms and bladed weapons); software containing high-value information; technology (phone, tablet, pc, smartphone); garbage; political material; dangerous materials; narcotics or psychotropic substances; art objects; antiques; metals (gold, silver in any form and precious stones); bulky goods; documents (offers, securities, meal vouchers, etc.); watches.
The following items can only be accepted with specific written authorization: food and pharmaceutical products; cigarettes and alcohol; fragile objects (glass, bottles); biological tissues and anatomical parts. The customer acknowledges and accepts that the storage of such goods is subject to specific regulations.
RIGHT OF INSPECTION
The Customer acknowledges and accepts that KUBOGREEN by Davide La Mantia and/or any Governmental Authority have the right to open and inspect the luggage at any time for security reasons.
CUSTOMER OBLIGATIONS
The customer guarantees that: (A) the contents of the luggage have been properly described; (B) address and contacts are accurate; (C) the contents are safely packed; (D) it does not cause damage to other luggage; (E) it is not a prohibited item; (F) in the event of non-payment by third parties, they will be obliged to pay; (G) applicable laws have been complied with; (H) the economic value of each piece of luggage including its contents does not exceed € 500. The customer agrees to indemnify us and hold us harmless from any liability, cost or damage resulting from the breach of these obligations.
EXTENT OF OUR LIABILITY
Our liability for the risks of loss or damage to your luggage during the storage period, specifically attributable solely to the liability of KUBOGREEN by Davide La Mantia, cannot under any circumstances exceed the amount of € 500.00 for the contents of the locker covered by insurance. No liability is attributable in the case of delayed and/or uncollected luggage beyond the opening/closing times. We will not be liable for any missed flights, trains, loss of earnings, indirect or consequential damages. We are not liable for force majeure (earthquakes, strikes, terrorist acts, theft, robbery, arson, inherent defects of the luggage). We are not responsible for broken handles and/or wheels.
INSURANCE
Each locker is covered by insurance up to a maximum value of EUR 500.00 for its contents, which will compensate the customer for damages attributable to us within the stated limits and in the event of proven theft by third parties. Coverage is not available for precious stones, precious metals, watches, screens, navigators, cell phones, PCs, tablets, jewelry, money, glass, porcelain, art, antiques, documents or data carriers. It does not cover consequential losses or the breakage of handles/wheels. All stores are equipped with 24h video surveillance and an alarm system.
COMPLAINTS, DISPUTES
Any claims for loss or damage must be submitted in writing within 8 days from the end date of the rental. The customer must then provide documentary evidence. The contents of the luggage must be made available to us for inspection upon collection. The customer cannot deduct claims from the amounts due.
RATES AND PAYMENT TERMS
The card charge will include the cost of the rented time slot together with the service cost of 0.50 euros. Any disputes regarding charges must be sent within 7 days of payment. Late payments may result in default interest (Legislative Decree 231/02).
APPLICABLE LAW AND JURISDICTION
Any dispute arising from and/or connected to this storage contract will be governed by Italian law. For any dispute relating to the relationship between the parties, the consumer court (Article 33, paragraph 2 of Legislative Decree 206/2005) shall have exclusive jurisdiction.
